Welcome to Zkart Logistics. By accessing our website, creating an account, or booking a vehicle, you agree to these Terms and Conditions. Please read them carefully. If you do not agree, please do not use our services.
1. About us
Zkart Logistics ("Zkart", "we", "us", "our") provides intracity and intercity goods transport and logistics services. We currently serve Coimbatore and Palakkad and are expanding across South India. Our registered address is 14/10, Sakthi Avenue 2nd Street, Balaji Gardens Extension, Subramaniampalayam, G N Mills, Coimbatore - 641029, Tamil Nadu, India.
2. Our service
Zkart connects customers who need to move goods with vehicles and drivers. When you book, you select a vehicle type, provide pickup and drop-off details, and receive an estimated fare before you confirm. Final charges may differ from the estimate based on actual distance, waiting or detention time, tolls, permits, and any applicable Goods Protection Fee.
3. Accounts
To book, you must register with a valid name, phone number, and (optionally) email. You are responsible for keeping your login details secure and for all activity under your account. You must be at least 18 years old and legally able to enter into a contract.
4. Bookings and fares
- Fares are quoted as estimates and are calculated on either a distance ("Metre") basis or a package basis, as shown at the time of booking.
- Additional charges may apply for waiting time, detention, tolls, permits, and Goods Protection, and will be reflected in your final invoice.
- We may decline or cancel a booking where the requested service cannot be safely or lawfully provided.
5. Prohibited and restricted goods
You must not book our services to transport any of the following:
- Illegal goods, contraband, or anything prohibited under Indian law.
- Hazardous, flammable, explosive, toxic, radioactive, or otherwise dangerous materials, unless expressly agreed in writing in advance and transported in compliance with all applicable regulations.
- Live animals, human remains, or biological materials, unless expressly agreed in advance.
- Perishable goods without informing us in advance of their nature and handling needs.
- Cash, bullion, jewellery, negotiable instruments, or similarly high-value items, unless expressly agreed in advance and properly declared and protected.
- Any goods you do not have the legal right to transport.
You are responsible for accurately declaring the nature, weight, and value of your goods. Misdeclaration may result in refusal of service, additional charges, cancellation without refund, and liability for any resulting loss.
6. Goods Protection Fee
- When you opt in and pay the Goods Protection Fee, Zkart will cover verified loss of, or damage to, your goods that occurs while the goods are in the custody of our vehicle, up to the value you declare at the time of booking, and subject to these terms.
- Claims require the original goods invoice and our pickup and delivery records. Claims relating to theft additionally require a police First Information Report (FIR).
- The Goods Protection Fee is calculated based on the declared value of the goods.
- Cover does not apply to: goods that were misdeclared or undervalued; prohibited or restricted goods carried without prior agreement; damage arising from inherent defects, poor packing by the customer, or normal handling of fragile items not declared as fragile; loss or damage caused by events beyond our reasonable control (see Force Majeure); and consequential or indirect losses.
- Fraudulent, exaggerated, or misdeclared claims will be rejected and may be reported to the authorities.
If you require formal transit insurance or marine insurance for your goods, that is your own responsibility. Zkart does not sell or provide insurance. For high-value shipments, we recommend you arrange appropriate insurance cover through a licensed insurer before booking. The Goods Protection Fee is not a replacement for such insurance.
7. Your responsibilities
- Provide accurate pickup, drop-off, goods, and contact details.
- Ensure goods are properly and safely packed for transport.
- Ensure someone authorised is available at pickup and drop-off.
- Provide the correct receiver details so goods are handed to the right person.
- Comply with all applicable laws relating to the goods being transported.
8. Payment
Payment is made through the methods offered on our platform, which may include UPI and, where available, online payment via our payment gateway partner (Razorpay). Advance payment may be required for certain bookings. You agree to pay all charges shown on your final invoice.
9. Liability
- Zkart's total liability in connection with any booking is limited to the amount actually covered under the Goods Protection Fee for that booking (if opted in), or otherwise to the amount you paid for that booking.
- Zkart is not liable for indirect, incidental, or consequential losses, including loss of profit, loss of business, or loss of opportunity.
- Nothing in these terms limits liability where it cannot lawfully be limited.
10. Force Majeure
Zkart is not responsible for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, accidents, strikes, riots, government action, road closures, extreme weather, or breakdowns.
11. Suspension and termination
We may suspend or close your account if you breach these terms, misuse the service, provide false information, or engage in unlawful activity.
12. Changes to these terms
We may update these terms from time to time. The current version will always be available on our website, with the "last updated" date shown. Continued use of our services means you accept the updated terms.
13. Governing law and jurisdiction
These terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts at Coimbatore, Tamil Nadu.
